1Who we are
Povie Studio (poviestudio.com) is run by [COMPANY LEGAL NAME], registered at [REGISTERED ADDRESS]. In these terms, "we", "us" and "our" mean [COMPANY LEGAL NAME], and "you" means the person using Povie Studio.
You can reach us any time at jake@kokoai.im.
These terms work together with our Privacy Policy (how we handle your information) and our Refund and Cancellation Policy.
2Who can use Povie Studio
- You must be at least 13 years old. Povie Studio is not for children under 13.
- If you're under 18 (or under the age of adulthood where you live), you need permission from a parent or guardian. Show them these terms.
- Some countries say that people under a certain age (for example, under 16 in parts of Europe) need a parent's consent to sign up for an online service or share personal information. If that applies to you, you can only use Povie Studio with that consent.
- Only adults can pay. If you're under 18, a parent or guardian must make or approve any purchase. PayPal's own rules also generally require account holders to be adults.
- If you're a parent or guardian and you let your teen use Povie Studio, you agree to these terms for them and you're responsible for their use and any purchases.
- You can't use Povie Studio if we've banned you before, or if the law where you live doesn't allow you to.
3Your account
Right now there are no accounts. You can only leave your email to hear when Povie Studio opens. Once it opens, you'll need an account to make videos. When you have one:
- Give us true information and keep it up to date.
- Keep your login safe and don't share it.
- One person per account. Don't buy, sell, rent or give away accounts.
- You're responsible for what happens in your account. If you think someone else got in, tell us right away at jake@kokoai.im.
4What Povie Studio does
Povie Studio is a web service that runs in your browser, with nothing to download. You type your POV (one sentence), select characters and a place, and Povie Studio makes the video. Povie Studio uses AI (artificial intelligence) to turn that into a short vertical video you can download and post on TikTok, Instagram Reels, YouTube Shorts and other apps.
Povie Studio isn't open yet. Today the site only collects early-access emails, and nothing is for sale. When we open, some features may be marked "beta" or "preview". They may change, break or be removed.
5What you type and pick (your input)
"Input" means everything you give Povie Studio to make a video: the sentence you type, the characters and places you pick, and anything else you send us.
- You're responsible for your input. Only use words, names and material you have the right to use.
- You keep any rights you already have in your input.
- You give us permission to use it to run Povie Studio. That means making your videos, saving them for you, keeping the service safe, fixing bugs and making Povie Studio better. This permission (a "license") is worldwide and free, and it lasts only as long as we need it for those things. Companies that help us run Povie Studio, like the AI providers that make the video, may use it for us for the same purposes.
- We won't put your input or your videos in our ads or marketing without asking you first.
6Videos you make (AI output) and who owns them
"Output" means the videos, images, sound and text Povie Studio makes for you.
You own your output
Between you and us, you own the output you make, as far as the law allows. We give you any rights we have in it, except for Povie materials (see below). The permission you gave us in section 5 also covers your output, so we can save it, show it to you and keep the service running.
Things to know about AI output
- In some countries, content made by AI may not be protected by copyright, so you might not be able to stop other people from copying it.
- Other people may get output that looks like yours, especially if they type something similar. You don't own their output, and they don't own yours.
- AI can get things wrong. Watch your video before you post it. You're responsible for what you post.
Povie materials stay ours
The characters, places, art styles, voices, sounds, templates and the Povie Studio name and logo ("Povie materials") belong to us or to people who license them to us. As long as you follow these terms, you may use Povie materials as they appear inside videos you make with Povie Studio. That includes posting those videos on social media and earning money from those posts through the app's creator programs.
You may not take Povie characters or places out of your videos to use on their own, for example as a logo, on merchandise, or to train another AI model.
7What you can't make or do
Don't use Povie Studio to make, post or share anything that:
- Copies someone else's work without permission, like characters from shows or games, songs, logos or brands.
- Is hateful: attacks or puts people down because of race, ethnicity, nationality, religion, disability, sex, gender identity, sexual orientation, age or anything similar.
- Is sexual or shows nudity, or sexualizes anyone. Never anything sexual involving a minor. We report child sexual abuse material to the authorities.
- Bullies, harasses or threatens anyone, or is made to embarrass a real person.
- Pretends to be someone. Don't impersonate a real person, brand or organization. Don't show a real person (a celebrity, a classmate, a teacher, anyone) saying or doing things they didn't, including deepfakes.
- Encourages harm: violence, self-harm, eating disorders, dangerous challenges, terrorism, or illegal things like drugs or weapons.
- Misleads people in a harmful way, like fake news, scams, or made-up "proof" that something happened.
- Shares someone's private information, like their address, phone number or school.
- Is spam or is meant to trick apps, for example to fake views or followers.
And don't:
- Try to get around our limits, filters or security.
- Copy, scrape or reverse-engineer Povie Studio, or use bots to access it, except where the law allows.
- Use Povie Studio or its output to build a competing service or to train AI models.
- Resell or share your access, or use someone else's account or payment method without their permission.
- Upload viruses or anything harmful, or overload our systems.
- Break any law.
8How we enforce the rules
- We use automatic filters and human review. We can block a prompt, refuse to make a video, remove output, warn you, or limit, suspend or close your account if we believe you broke these terms or the law, or to protect other people or Povie Studio.
- We may keep records and report to the police or other authorities when the law requires it or when someone's safety is at risk.
- We can't check everything, and we're not responsible for what people post on other apps.
- If you think we got it wrong, email us and we'll take another look.
Report a video or a copyright problem
If you think something made with Povie Studio breaks these rules or copies your work, email jake@kokoai.im with:
- your name and how to contact you,
- what you think was copied or what rule was broken,
- a link to the video or where you saw it, and
- for copyright: a statement that you believe in good faith the use isn't allowed, and that the information you sent is accurate.
We may close the accounts of people who break copyright rules again and again.
9Paid plans and billing through PayPal
Povie Studio will offer paid plans (subscriptions) and/or credits. Nothing is for sale yet. When it is:
- You see the price first. Before you pay, we show the price, what you get, how often you'll be charged (for subscriptions) and the total including any tax. Current plans and prices are listed on our Refund and Cancellation Policy page: [PRICE].
- PayPal handles payments. You pay through PayPal's checkout, under PayPal's own terms and privacy statement. We never see or store your full card or bank details.
- Taxes. Depending on where you live, sales tax, VAT or GST may apply. The total you pay is shown at checkout.
- Subscriptions renew automatically. At the end of each billing period (for example monthly or yearly, as shown at checkout), PayPal charges the payment method you chose, until you cancel. We show the renewal price and date before you subscribe and in your account.
- Cancel any time. Cancel in your Povie Studio account settings, or in PayPal under Settings, then Payments, then Manage automatic payments. Cancelling stops future charges. You keep access until the end of the period you already paid for.
- Credits. Credits are used to make videos, and we show how many a video costs before you make it. Credits have no cash value, can't be transferred or swapped for money, and [CREDIT EXPIRY, e.g. do not expire].
- Free trials and promotions. If we offer a free trial, we'll tell you when it ends and what you'll be charged after. Cancel before it ends and you won't be charged.
- Price changes. We may change prices. If a change affects your subscription, we'll email you before it applies, and you can cancel before it does.
- Failed payments. If a payment doesn't go through, we may pause paid features until it's fixed.
10Refunds
Our Refund and Cancellation Policy explains when and how you can get your money back, including for duplicate or mistaken charges. It's part of these terms.
If you have a problem with a charge, please email us before opening a PayPal dispute. It's usually faster. You still keep every right you have under PayPal's rules and under consumer law.
11Changes to Povie Studio and availability
- Povie Studio is new and still being built. We may change, add or remove features, change limits, or stop offering Povie Studio.
- We work to keep it running, but it may sometimes be slow, unavailable or lose data. Download any video you want to keep.
- If we shut Povie Studio down for good, we'll give you reasonable notice when we can, and refund any unused prepaid time or credits, in proportion to what's left.
12TikTok, Instagram, YouTube and other apps
- When you post a video on another app, that app's own terms and privacy policy apply to what happens there. If Povie Studio lets you post straight to another app, it posts only when you tell it to.
- Follow the rules of the app where you post, including any rules about labeling AI-made content.
- TikTok, Instagram, Reels, YouTube and Shorts belong to their owners. Povie Studio isn't affiliated with or endorsed by them.
13Disclaimers
- Povie Studio is provided "as is" and "as available". As far as the law allows, we don't make promises beyond the ones written in these terms. For example, we don't promise it will always work, be free of errors, or be right for what you want.
- AI output can be strange, wrong or similar to other people's output.
- No promise of views, followers or money. The view counts on our home page belong to example videos. Your results will be different.
- Nothing in these terms takes away rights you have under consumer protection laws that can't legally be waived.
14Limits on our liability
- As far as the law allows, we're not responsible for indirect or unexpected losses, like lost profits, lost data, lost followers or damage to reputation.
- As far as the law allows, our total responsibility for any claim about Povie Studio is limited to the larger of (a) what you paid us in the 12 months before the claim, or (b) [LIABILITY CAP, e.g. USD 50].
- These limits don't apply where the law doesn't allow them, for example for death or personal injury caused by our negligence, or for fraud. If you live in the EU or UK, we're responsible for losses you suffer that were a foreseeable result of us breaking these terms or not using reasonable care and skill.
15Ending your use
- You can stop any time. You can delete your account in your settings or by emailing us. Deleting your account also cancels any subscription.
- We can suspend or close an account that breaks these terms or the law, puts others at risk, or if we stop offering Povie Studio. We'll tell you why when we can, unless the law or safety reasons stop us.
- If we close your account when you haven't broken these terms, we'll refund any unused prepaid time or credits.
- Parts of these terms that are meant to last after your account ends (like ownership, disclaimers, limits on liability and governing law) keep applying.
16Governing law and disputes
- These terms are governed by the laws of [COUNTRY / GOVERNING LAW], and disputes go to the courts of [COUNTRY / GOVERNING LAW].
- If you're a consumer living somewhere else, you still keep the protection of the laws where you live that can't be changed by contract, and you may be able to bring a claim in your local courts.
- Please email us first if something goes wrong. Most problems can be fixed quickly.
17Changes to these terms
We'll update these terms as Povie Studio grows. The "Last updated" date at the top shows the latest version. For important changes, we'll tell you before they apply, by email or on the site. If you keep using Povie Studio after the changes apply, you agree to the new terms. If you don't agree, stop using Povie Studio and delete your account.
18The small print
- These terms, the Privacy Policy and the Refund and Cancellation Policy are the whole agreement between you and us about Povie Studio.
- If a court decides part of these terms can't be enforced, the rest still applies.
- If we don't enforce a rule right away, we can still enforce it later.
- We may transfer these terms to a company that takes over Povie Studio. You can't transfer them without our OK.
- If you send us ideas or feedback, we may use them without paying you.
